Acceptable Use Policy (AUP)

Guidelines for responsible use of Axel Networks' internet services and network resources.

1. Introduction

This Acceptable Use Policy ("AUP") is designed to protect Axel Networks ("we," "us," or "our"), our customers ("you"), and the internet community from irresponsible or illegal activities. Use of Axel Networks' services constitutes acceptance of this AUP. We may modify this AUP at any time by posting a revised version on our website.

2. Prohibited Uses and Activities

You may not use Axel Networks' services or network (the "Services") to engage in, foster, or promote illegal, abusive, or irresponsible behavior, including but not limited to:

  • Illegal Activities: Any use of the Services in violation of any applicable local, state, federal, or international law or regulation. This includes, but is not limited to, posting or transmitting child pornography, CPNI violations, or material that is obscene, defamatory, or constitutes an illegal threat.
  • Harm to Minors: Using the Services to harm, or attempt to harm, minors in any way.
  • Intellectual Property Infringement: Transmitting, distributing, or storing any material that infringes any copyright, trademark, patent, trade secret, or other intellectual property right of any third party.
  • Network Abuse:
    • Distributing or transmitting viruses, worms, Trojan horses, malware, or any other malicious or destructive code.
    • Engaging in denial of service (DoS) or distributed denial of service (DDoS) attacks, or any other activity that attempts to disrupt, degrade, or interfere with the Services or any other network or system.
    • Attempting to gain unauthorized access to or use of data, systems, or networks, including any attempt to probe, scan, or test the vulnerability of a system or network or to breach security or authentication measures without express authorization of the owner of the system or network.
    • Monitoring data or traffic on any network or system without the express authorization of the owner of the system or network.
  • Spam and Unsolicited Communications: Transmitting any unsolicited commercial email (spam), unsolicited bulk email, or any other form of unsolicited electronic communication. This includes operating an open mail relay or engaging in activities that facilitate spam.
  • Fraudulent Activities: Engaging in any activity that is fraudulent, including but not limited to phishing, impersonation, or creating a false identity for the purpose of misleading others.
  • Security Violations: Violating or attempting to violate the security of the Services or any third-party system or network.
  • Excessive Resource Usage: Using the Services in a manner that consumes excessive network resources or has a detrimental effect on other customers' ability to use the Services. This applies particularly to residential plans not intended for heavy commercial server use.
  • Resale of Service: Reselling the Services or any part thereof without express written permission from Axel Networks.

3. Network Management

Axel Networks reserves the right to manage its network to ensure the security, integrity, and optimal performance of the Services for all customers. Network management practices may include, but are not limited to: (a) traffic prioritization for latency-sensitive applications; (b) blocking of known malicious traffic or ports commonly used for abuse; (c) rate limiting of certain protocols or traffic types if they are determined to be detrimental to overall network performance; and (d) other measures deemed necessary to protect the network and ensure fair access for all users.

We do not generally engage in deep packet inspection of customer traffic for network management purposes, except as necessary for security or to comply with legal requirements.

4. Content

You are solely responsible for any information that you publish or transmit using the Services. Axel Networks does not review, edit, censor, or take responsibility for any information customers may create or access on or through the Services. However, we reserve the right to remove any content that violates this AUP or is otherwise illegal or harmful, or to suspend or terminate service to customers who engage in such violations.

5. Reporting Violations

If you become aware of any violation of this AUP by an Axel Networks customer, please notify us immediately by emailing abuse@axel-networks.com. Please include as much information as possible to assist us in our investigation, including IP addresses, dates, times, and any relevant logs or evidence.

6. Consequences of Violation

Violation of this AUP may result in a range of actions, including but not limited to:

  • Issuing a warning.
  • Suspending access to the Services.
  • Terminating the Services and your account.
  • Billing for administrative costs and/or reactivation charges.
  • Bringing legal action to enjoin violations and/or to collect damages, if any, caused by violations.
  • Reporting illegal activities to law enforcement authorities.

We reserve the right to act immediately and without notice to suspend or terminate Services in response to a court order or other legal requirement, or if we determine, in our sole discretion, that your conduct may: (1) expose Axel Networks to sanctions, prosecution, or civil action; (2) cause harm to or interfere with the integrity or normal operations of our network or networks with which we are interconnected; (3) interfere with another customer's use of the Services; (4) violate any applicable law, rule or regulation; or (5) otherwise present an imminent risk of harm to Axel Networks or our customers.

7. Revisions to This Policy

Axel Networks reserves the right to revise, amend, or modify this AUP at any time and in any manner. Notice of any revision, amendment, or modification will be posted on our website.
